Regulations on the Committee for Tourism Development under the Government of the Republic of Tajikistan
(as amended by the Decree of the Government of RT dated 14/11/2019 No. 576)

1. General provisions

1. The Committee for Tourism Development under the Government of the Republic of Tajikistan (hereinafter referred to as the Committee) is the central executive body of state power, performing special executive, control, licensing and other functions established in the field of tourism development.

2. The Committee shall be guided in its activities by the Constitution of the Republic of Tajikistan, constitutional laws, codes, laws, international legal acts recognised by Tajikistan, joint resolutions of Majlisi Milli and Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan, resolutions of Majlisi Milli and Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan, decrees of the President of the Republic of Tajikistan, resolutions of the Government of the Republic of Tajikistan, other normative legal acts and the present Regulation.

3. The Committee shall, in accordance with the established normative legal acts of the Republic of Tajikistan, perform its activities, by interacting with the central executive bodies of state power, local executive bodies of state power, international and public  organizations and other organizations to develop and implement the state policy in the field of tourism.

2. Powers of the Committee

4. The main powers of the Committee are the following:  

– implement the state policy and coordination of tourism activities in the Republic of Tajikistan;

– implement state tourism programmes in Tajikistan;

– ensure the implementation of international treaties and agreements in the field of tourism;

– represent the interests of the Republic of Tajikistan in international tourism organizations;

– cooperate and interacts with public organizations in the field of tourism;

– develop normative legal acts and determines state standards for rendering service to tourists in the field of activity in accordance with the established procedure;

– prepare proposals to the Government of the Republic of Tajikistan on attracting investments to develop tourism sector in accordance with the established procedure;

– coordinate the activities and regulatory and methodological guidance of tourism entities;

– carry out licensing of tourism activities in accordance with the established procedure;

– determine proportionally equal tourism quotas among tourism entities to visit tourist and sightseeing sites included in the State Cadastre of Tourist Resources of the Republic of Tajikistan, due to the need to preserve them from destruction;

– supervise compliance with the quality of provided tourism services and fulfilment of licensing and certification conditions in the field of tourism;

– select, train and deploy staff (except for non-state entities engaged in tourist activities), conducts research works in the field of tourism, and establishes the State Cadastre of Tourist Resources;

– develop proposals for the import and export of tourism services in accordance with the legislation of the Republic of Tajikistan;

– develop proposals on unified tariffs for mountaineering, mountain rescue fees, environmental fees in accordance with the legislation of the Republic of Tajikistan;

– conduct international, regional and republican competitions, festivals, conferences, forums, fairs and exhibitions in line with the established order;

– perform the functions of the chief controller and recipient of the republican budget funds envisaged for the maintenance of the Committee and implementation of the functions vested in the Committee;

– ensure protection of state secret information within its competence;

– arrange professional training, retraining, advanced training and internships for the Committee’s staff;

– interact with public authorities of foreign states and international organizations in the established area of activity in accordance with the established procedure;

– conduct work on acquisition, storage, accounting and use of archival documents formed in the course of the Committee’s activities in accordance with the legislation of the Republic of Tajikistan;

– exercise other powers stipulated by the legislation of the Republic of Tajikistan.

5. The Committee has the right to exercise its powers in the established area of activity:

– request and receive from central and local executive bodies of state power, individuals and legal entities the information required for the qualitative implementation of the state policy on tourism development, as well as for making decisions on issues within the competence of the Committee;

– establish departmental service insignia, awards, and reward employees, individuals and legal entities for high achievements in the established sphere of activity in accordance with the legislation of the Republic of Tajikistan;

– engage scientific and other organizations, scientists and specialists to study issues in the relevant field of activity;

– create coordination, advisory and expert bodies (councils, commissions, groups), creative and labor teams for implementation of specific programs and projects in the area within the competence of the Committee and approve their provisions;

– submit a proposal to the Government of the Republic of Tajikistan on establishment and liquidation of the Committee’s institution and organization system in accordance with the legislation of the Republic of Tajikistan.

6. The Committee is not entitled to exercise the control and supervision functions in the established area of activity, as well as the functions of state property management, except for the cases established by decrees of the President of the Republic of Tajikistan and decrees of the Government of the Republic of Tajikistan. The restrictions set forth in this paragraph shall not apply to the powers of the Chairman to manage the property assigned to the Committee under the right of operational management, to resolve personnel issues and issues of organization of Committee’s activities.

When exercising legal regulation in the specified field of activity, the Committee shall not be entitled to establish functions and powers of central executive bodies, local executive bodies of state power, local self-government bodies not stipulated by constitutional laws and laws of the Republic of Tajikistan, acts of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan, and shall not be entitled to establish restrictions on exercise of rights and freedoms of citizens, rights of non-state commercial and non-commercial organizations, except for the cases when the possibility of introducing such restrictions by acts of the authorised central bodies of executive power is directly provided by the Constitution of the Republic of Tajikistan and constitutional laws, laws of the Republic of Tajikistan, acts of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan.

3. Activity arrangement

7. The Committee shall be headed by the Chairman appointed and dismissed by the Government of the Republic of Tajikistan. The Chairman shall be personally responsible for implementation of authorities assigned to the Committee and implementation of the state policy in the specified area of activity.

8. The Chairman shall have deputies, including one first deputy appointed and dismissed by the Government of the Republic of Tajikistan upon his nomination. The number of Deputy Chairman shall be determined by the Government of the Republic of Tajikistan.

9. The structural subdivisions of the Committee shall be departments, divisions and sectors in the main areas of the Committee’s activities. The departments shall include divisions and sectors that shall be established, reorganized and abolished by orders of the Chairman of the Committee in accordance with the established procedure.

10. Within his power, the Chairman shall do the following:

– distribute duties among his deputies;

– approve the regulations (charters), structural subdivisions of the central office and bodies specified in the management chart of the Committee;

– appoint and dismiss employees of the central office and bodies specified in the management chart of the Committee, institutions and organizations of the Committee system in accordance with the legislation of the Republic of Tajikistan;

– resolve, in accordance with the legislation of the Republic of Tajikistan on civil service, issues related to civil service in the Committee;

– approve the structure and staffing of the Committee in a standard manner within the framework of the wage fund and the number of staff established by the Government of the Republic of Tajikistan, unified income and expenditure estimate for the maintenance of the Committee within the funds provided in the national budget for the relevant period;

– approve the annual work plan and forecasts of activities of the Committee’s institutions and organizations, as well as reports on their implementation;

– approve draft regulations (charters), staffing and wage fund for their employees as advised by the heads of institutions and organizations of the Committee;

– submit proposals to the Ministry of Finance of the Republic of Tajikistan on formation of the national budget in terms of financial support to the Committee, institutions and organization of its system in accordance with the established procedure;

– within the specified powers, give instructions to the institutions and organizations of the Committee’s system and supervise their performance;

– cancel decisions of the Committee’s institutions and organizations contradicting to the legislation, unless another procedure for cancelling a decision is not stipulated by the legislation;

– appoint and dismiss the deputies upon recommendation of the heads of institutions and organizations of the Committee;

– advise staff of the Committee, institutions and organizations of the Committee, other individuals performing activities in the established area to be awarded with state awards of the Republic of Tajikistan in accordance with the established procedure;

– in case of failure to perform functional duties, violation of labor discipline, in accordance with the procedure established by the legislation of the Republic of Tajikistan, take measures with regard to employees of the Committee, institutions and organizations of its system within his power;

– arrange the reception of individuals and legal entities, ensure timely and full consideration of their oral and written applications, take decisions on them and send responses to the applicants within the time period established by the legislation of the Republic of Tajikistan;

– adopt orders of a normative nature, and orders of non-normative nature on operational and other day-to-day issues concerning the organisation of the Committee’s activities.

The Committee shall form a Council Board consisting of the Chairman of the Committee (Chairman of the Board) and his/her deputies (by position). The Committee’s board may include senior officials of the Committee, subordinate organisations of the Committee, representatives of the executive bodies of state power and representatives of tourist public organisations.

12. The members of the Board, except for the Chairman and the Deputies, who are ex officio members of the Board, shall be approved by the Government of the Republic of Tajikistan upon the recommendation of the Chairman of the Committee.

13. The Council Board shall review critical issues related to the activities of the Committee. The Board decisions shall be reflected in minutes, and implemented by the orders of the Committee Chairman. The Board meetings shall be competent if attended by more than half of its members. The Board decisions on issues under consideration shall be taken by a majority vote.

14. The central office of the Committee shall be financed from the national budget and other funds as agreed with the Ministry of Finance of the Republic of Tajikistan.

15. The Committee is a legal entity and has a seal with the State Emblem of the Republic of Tajikistan and its name in the national and foreign languages, seals, stamps and letterheads of the established form and is financed from the unified personal account of the Main Department of the Central Treasury of the Ministry of Finance of the Republic of Tajikistan.

16. The Committee has property with the right of operational management, has an independent balance sheet and a special settlement account, and may conclude contracts on its own behalf, acquire property rights, and act in court as a claimant or defendant.
