RESOLUTION
About the Committee of Tourism Development under the Government of the Republic of Tajikistan
 In accordance with article 12 of the constitutional Law of the Republic of Tajikistan “On the Government of the Republic of Tajikistan” the Government of the Republic of Tajikistan decrees:
  1. Create a Committee of Tourism Development under the Government of the Republic of Tajikistan.
  2. Approve the regulations, structure of the central office, the management scheme and the list of local executive bodies of state power on the establishment of departments and sectors of tourism development of Tourism Development Committee under the Government of the Republic of Tajikistan (appendices 1,2,3 and 4).
  3. Set the maximum number of employees of the central office of the Tourism Development Committee under the Government of the Republic of Tajikistan in the amount of 32 units (without service personnel).
  4. Allow the Committee of Tourism Development under the Government of the Republic of Tajikistan to have 2 deputy chairmen, including one first deputy, as well as a board of 7 people.
  5. Set a limit of 4 official passenger cars for the Committee of Tourism Development under the Government of the Republic of Tajikistan.
  6. The Central office of the Committee for Tourism Development under the Government of the Republic of Tajikistan should be financed from the national budget and other funds in coordination with the Ministry of Finance of the Republic of Tajikistan.
  7. The Committee of Tourism Development under the Government of the Republic of Tajikistan within two months, in accordance with the established procedure, to submit proposals for amendments and additions to the sectoral regulatory legal acts of the Republic of Tajikistan.
  8. Create a staff number of departments and sectors of the Tourism Development Committee under the Government of the Republic of Tajikistan in the structure of local executive bodies of state power of Mountainous-Badakhshan autonomous region, regions, the city of Dushanbe, cities and districts in the amount of 44 staff units in accordance with Annex 4.
  9. The Ministry of Finance of the Republic of Tajikistan:
– in the prescribed manner to develop and submit a draft act on amending resolution of the Government of the Republic of Tajikistan from March 3, 2011, No. 115 “About the standard position and structure of the chairman office, local executive bodies of state power, self-government bodies of settlements and villages and limits of the total number of civil servants of local executive bodies of state power”;
– to provide expenses for the maintenance (wages and social insurance) of 44 state departments and sectors for the development of tourism in the structures of local executive bodies of state power from June 1, 2017 at the expense of the republican budget and in subsequent years at the expense of the local budget.

Regulations on the Committee of tourism development under the Government of the Republic of Tajikistan

  1. General provisions
  2. The Tourism Development Committee under the Government of the Republic of Tajikistan (hereinafter referred to as the Committee) is a central executive body of state power that conducts special executive, control, licensing and other functions established in the field of tourism development.
  3. The Committee is guided by the Constitution of the Republic of Tajikistan, constitutional laws, codes, laws, international legal acts ratified by Tajikistan, joint resolutions of Majlisi Milli and Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan, resolutions of Majlisi Milli and Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan, decrees of the President of the Republic of Tajikistan, resolutions of the Government of the Republic of Tajikistan, other regulatory legal acts and this resolution.
  4. The Committee, in accordance with the established normative legal acts of the Republic of Tajikistan, carries out its activities in cooperation with the central executive bodies of state power, local executive bodies of state power, international and public organizations and other organizations for the development and implementation of state policy in the field of tourism.
  5. Powers of the Committee
  6. The main Powers of the Committee are:
– implements state policy and coordination of tourism activities in the Republic of Tajikistan;
– carries out the state program of tourism in Tajikistan;
– ensures the implementation of international agreements and agreements in the field of tourism;
– represents the interests of the Republic of Tajikistan in international tourism organizations;
– cooperates and interacts with public organizations in the field of tourism;
– in accordance with the established procedure, develops regulatory legal acts and defines state standards for tourist services in the field of activity;
– in accordance with the established procedure, prepares proposals to the Government of the Republic of Tajikistan on attracting investment for the development of the tourism sector;
– coordinates the activities and regulatory-methodological management of tourism entities;
– performs licensing of tourist activities in accordance with the established procedure;
– determines proportionally equal tourist quotas between the subjects of tourist activity for visiting tourist and excursion objects, included in the state cadaster of tourist resources of the Republic of Tajikistan, due to the need to preserve them from destruction;
– monitors compliance with the quality of tourist services provided and compliance with the conditions of licensing and certification in the field of tourism;
– performs selection, training and placement of personnel (except for non-state subjects of tourism activities), conducting research in the field of tourism, creating a state cadaster of tourist resources;
– in accordance with the legislation of the Republic of Tajikistan, develops proposals for the import and export of tourist services;
– in accordance with the legislation of the Republic of Tajikistan, develops proposals for unified tariffs for climbing mountain peaks, mountain rescue fees, and environmental charges;
– conducts international, regional and national competitions, festivals, conferences, forums, fairs and exhibitions in accordance with the established procedure;
– performs the functions of the chief administrator and recipient of the republican budget funds provided for the maintenance of the Committee and the implementation of the functions assigned to the Committee;
– ensures, within its competence, the protection of information constituting a state secret;
– organizes professional training of Committee employees, their retraining, advanced training and internships;
– in accordance with the established procedure, interacts with state authorities of foreign states and international organizations in the established field of activity;
– carries out, in accordance with the legislation of the Republic of Tajikistan, work on the acquisition, storage, accounting and use of archival documents formed in the course of the Committee’s activities;
– exercises other powers provided for by the legislation of the Republic of Tajikistan.
  1. The Committee, to exercise its powers in the established field of activity, has the right to:
– request and receive from central and local executive bodies of state power, individuals and legal entities, the necessary information for the qualitative implementation of the state policy on tourism development, as well as for making decisions on issues within the competence of the Committee;
– in accordance with the legislation of the Republic of Tajikistan, to establish departmental service distinctions and awards, and award them to employees, individuals and legal entities for high achievements in the established field of activity;
– involve scientific and other organizations, scientists and specialists to work out issues in the established field of activity;
– create coordination, advisory and expert bodies (councils, commissions, groups), creative and labor collectives for the implementation of specific programs and projects in the area referred to the competence of the Committee, and approve their provisions;
– in accordance with the legislation of the Republic of Tajikistan, submits a proposal to the Government of the Republic of Tajikistan on the establishment and liquidation of the institution and organization of the Committee system.
  1. The Committee may not exercise the functions of control and supervision, as well as the functions of state property management, in the established sphere of activity, except in cases established by decrees of the President of the Republic of Tajikistan and resolutions of the Government of the Republic of Tajikistan. The restrictions set forth in this paragraph do not apply to the powers of the Chairman to manage property assigned to the Committee on the right of operational management, to resolve personnel issues and issues related to the organization of the Committee’s activities.
In the implementation of legal regulation in the established field of activity the Committee has no the right to establish not provided for in the constitutional laws and the laws of the Republic of Tajikistan, acts of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan functions and powers of central executive authorities, local executive bodies of state power, bodies of local self-government, and is not entitled to set limits on the exercise of the rights and freedoms of citizens, rights of non-commercial and non-commercial organizations, except, when the possibility of introducing such restrictions by acts of authorized central executive bodies is expressly provided for by the Constitution of the Republic of Tajikistan and constitutional laws, laws of the Republic of Tajikistan, acts of the President of the Republic of Tajikistan and The government of the Republic of Tajikistan.
 
 
 
  1. Organization activities
  2. The Committee is headed by a Chairman appointed and dismissed by the government of the Republic of Tajikistan. The Chairman is personally responsible for the implementation of the powers assigned to the Committee and the implementation of state policy in the established field of activity.
  3. The Chairman has deputies, including one first Deputy, appointed and dismissed by the Government of the Republic of Tajikistan. The number of vice-chairmen is set by the Government of the Republic of Tajikistan.
  4. The structural divisions of the Committee are the departments, divisions and sectors for the main activities of the Committee. Departments and sectors that are created, reorganized and abolished in accordance with the established procedure by orders of the Committee Chairman are included in the structure of the departments.
  5. Chairman within the limits of his powers:
– distributes responsibilities among his deputies;
– approves regulations (charters), structural divisions of the central office and bodies specified in the management scheme of the Committee;
– in accordance with the legislation of the Republic of Tajikistan, appoints and dismisses employees of the central office and bodies specified in the management scheme of the Committee, institutions and organizations of the Committee system;
– decides, in accordance with the legislation of the Republic of Tajikistan on public service, issues related to public service in the Committee;
– approves the structure and staffing of the Committee in the standard order within the wage fund and the number of employees established by the Government of the Republic of Tajikistan, a single estimate of income and expenses for the maintenance of the Committee within the funds provided for in the national budget for the corresponding period;
– approves the annual work plan and forecast performance indicators of institutions and organizations of the Committee system, as well as reports on their implementation;
– approves the draft regulations (charters), the maximum number of staff and the remuneration fund for their employees on the recommendation of the heads of institutions and organizations of the Committee system;
– in accordance with the established procedure, submit to the Ministry of Finance of the Republic of Tajikistan proposals for the formation of the national budget in terms of financial support for the activities of the Committee, institutions and organizations of its system;
– within the established powers, issues instructions to institutions and organizations of the Committee system and monitors their implementation;
– cancels decisions of institutions and organizations of the Committee system that contradict the law, unless a different procedure for canceling the decision is established by law;
– on the recommendation of the heads of institutions and organizations of the system, the Committee appoints and dismisses their deputies;
– represents, in accordance with the established procedure, employees of the Committee, institutions and organizations of the Committee system, and other persons engaged in activities in the established field, to be awarded with state awards of the Republic of Tajikistan;
– in cases of non-performance of functional duties, violation of labor discipline, in accordance with the procedure established by the legislation of the Republic of Tajikistan, within the limits of its powers, take measures against employees of the Committee, institutions and organizations of its system;
– organizes the reception of individuals and legal entities, ensures timely and complete consideration of their oral and written applications, making decisions on them and sending responses to applicants within the time period established by the legislation of the Republic of Tajikistan;
– accepts orders that have a normative nature, and on operational and other current issues of organizing the Committee’s activities, orders of a non-normative nature.
  1. The Committee shall form a board under the Chairman of the Committee (Chairman of the board) and his deputies. The board of the Committee may include senior employees of the Committee, subordinate organizations of the Committee, representatives of executive bodies of state power and representatives of tourist public organizations.
  2. Members of the board, with the exception of the Chairman and his deputies are approved by the Government of the Republic of Tajikistan by the recommendation of the Chairman of the Committee.
  3. The board considers important issues related to the Committee’s activities. Decisions of the board are drawn up in minutes and implemented by orders of the Chairman of the Committee. Meetings of the board are eligible if more than half of its members participate in them. Decisions of the board on the issues under consideration are made by a majority vote.
  4. The Central office of the Committee is financed from the national budget and other funds in coordination with the Ministry of Finance of the Republic of Tajikistan.
  5. The Committee is a legal entity and has a seal with the state emblem of the Republic of Tajikistan and its name in official and foreign languages, stamps and letterheads of the established sample and financed from a unified account of the Main Department of Central Treasury of Ministry of Finance of the Republic of Tajikistan.
  6. The Committee has property with the right of operational management, has an independent balance sheet and a special settlement account, and can enter into contracts on its own behalf, acquire property rights, and act in court as an applicant or defendant.
